Recruitment Privacy Statement

1. Introduction
This is the recruitment privacy statement from Royal BAM Group nv and its subsidiaries and affiliates (hereinafter: “BAM” or “we”). This statement contains a description of how BAM handles the personal data of our (potential) job applicants (hereinafter: “applicants”). This privacy statement may be changed from time to time. The most recent version is published on our website.
2. When does this privacy statement apply?
This privacy statement is applicable to the processing by BAM of all personal data of its applicants.
3. Who is responsible for your personal data?
Royal BAM Group nv and the BAM subsidiary or affiliate where you apply are the controller for the processing of your personal data. This privacy statement indicates what personal data are processed by BAM and to which persons or entities the data will or may be provided. BAM has appointed a Privacy Officer. You can contact BAM’s Privacy Officer at privacy@bam.com.
4. Why do we process your personal data?
We process your personal data for recruitment purposes. If you contact one of our recruiters, apply for a vacancy, create a job alert, create a profile for tailored job recommendations or request to receive other career related communications, we include the personal data you provide to us in our recruitment database. We will process your personal data to manage your recruitment process and to communicate with you. For example, we may inform you about new vacancies, send you career related communications or invite you for recruitment activities. We also use your data for the development and improvement of our recruitment services and to take informed decisions on where to direct our resources and services in order to attract diverse talent and ensure a fair process. 

At BAM we highly value health, safety, security and integrity. We may therefore carry out pre-employment screening, including to the extent permitted by applicable law:
 
  • A medical examination in order to assess your suitability to carry out a role. This process is carried out by a registered medical professional or company doctor and involves informing BAM about how the results of the medical examination relate to the requirements of the role.
  • An assessment to assess suitability for a role.
  • A screening on your relevant certifications and licenses.  
  • Criminal records or background checks for integrity reasons for specific roles and positions.
  • Other checks required by law.

In case a pre-employment screening is needed you will be informed upfront via the job advert or via the recruiter before you confirm your application.
 
If we offer you a position at BAM, we will process your personal data to prepare and process an employment agreement and will request you for additional information necessary to enter into an employment agreement with you. We use your personal data for the conclusion, execution and termination of your employment agreement. We will then also store your personal data in our HR database. 

In our recruitment process, we might process your personal data for the following profiling purposes: by means of artificial intelligence, a match is made between the vacancies with the most interesting candidates in our recruitment database. This  will allow our recruiters to even better assess whether you are a suitable candidate for a vacancy. Please note that artificial intelligence will never decide whether you are an interesting candidate, our recruiters will.  
 
5. On what legal basis do we process personal data for this purpose?
The legal basis for processing your personal data for recruitment purposes is your consent, our legitimate interest in case of e.g. pre-employment screening, or our legal obligations. If a processing is based on your consent, you have the right to withdraw your consent at any time. If you withdraw your consent this does not affect the lawfulness of processing based on consent before withdrawal.
6. Which personal data do we process for this purpose?
For recruitment purposes we process the following personal data:
 
  • Contact information, such as your full name (including name prefix or title), email address and phone number(s).
  • General information, such as your residency and work authorization. 
  • Applicant information, such as your educational background, employer details and employment history, skills and experience, salary expectation level, professional licenses, memberships and affiliates, CV, cover letter, interview notes, outcome of application and, where you provide them, references and photographs. 
  • Information provided when you create your profile on our website: interests, preferred place of work, work experience, skills, and recent job title.
  • Information provided by your social media account where you sign in or register to apply for an actual or potential position using a social media account or when you add your URL LinkedIn profile to the apply form.
  • Information on your activities on our website, internet browser, IP-address and type of device depending on your cookie consent.
  • Financial information, such as payment-related information in relation to the payment of recruitment-related expenses, where relevant. 
  • Results of the pre-employment screening.
  • Diversity-related information including in relation to gender, disabilities, ethnicity, sexuality, religion and social background. The diversity data collected and processed will depend on, and only be collected in accordance with applicable local laws. Where applicable, it will form part of the application process and will be apparent at the point of collection.
  • For some functions we ask for a certificate of conduct or an extract criminal record to assess the suitability for the role, again only in accordance with applicable local laws.
  • Any other information relating to you which you may provide to us or a third party on your behalf (such as a reference or your CV).
7. How long do we retain your personal data for this purpose?
For this purpose, your personal data will be retained as long as necessary to complete the recruitment process. 

We will keep your resume and other data you send us in the context of a job application -with your consent- for a period for a period of 12 months, after submitting your application. 

If you create a job alert, we will store your e-mail address for 12 months or until you unsubscribe. If you do not confirm your job alert within 5 days, after you have provided your email address, your registration will be deleted automatically.

If you created a profile to receive tailored job recommendations or career related company updates, we will store your personal profile information for 12 months. Four weeks before the consent expires you will be notified and asked to renew your consent. If you do not want to renew your consent your profile will be deleted. 
 
8. Access to your personal data by third parties
BAM shares your personal data with several third parties if this is necessary for the execution of the agreement and to comply with any legal obligation. These parties include banks, insurers, ICT service providers, accountants, consultants, social media providers and subcontractors.

Our websites may contain links to third-party social media websites or may refer you to the websites of such social media providers, specifically LinkedIn, Twitter and Facebook which may have privacy notices that differ from ours. We are not responsible for the processing or disclosure of personal information collected through other websites or processed by these third-party social media providers.

If your personal data are transferred to a recipient in a country that does not provide an adequate level of protection of personal data, will BAM take measures to ensure that your personal data are adequately protected, such as entering into EU Standard Contractual Clauses with these third parties.
In other cases, your personal data will not be supplied to third parties, except when required by law. 

When a third party processes your personal data solely following BAM’s instructions, it acts as a data processor. We enter into an agreement with such a data processor concerning the processing of personal data to safeguard that your personal data are solely provided to the data processor to provide services to us. 
9. Cookies and similar techniques
BAM uses functional, analytical and tracking cookies. A cookie is a small text file which will be saved in the browser of your computer or tablet or smartphone when you first visit this website. BAM uses cookies with a pure technical functionality. These ensure that the website works properly and that, for example, your preferred settings are remembered. These cookies are also used to make the website work well and to optimise it. In addition, we place cookies that keep track of your browsing habits so that we can offer customised content and advertisements.

On your first visit to our website we already informed you about these cookies and asked consent to place them.
You can opt out of cookies by setting your browser to deactivate the saving of cookies. In addition, you can delete all previously saved information in your browser settings.

10. How are your personal data secured?
In order to ensure the confidentiality and security of your personal data, BAM has implemented appropriate technical, physical and organisational security measures to protect personal data against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorised disclosure or access, and against all other forms of unlawful processing (including, but not limited to unnecessary collection) or further processing.
11. Questions or requests for access, correction and removal?
You can request access, correction, restriction, portability or removal of the data that BAM processes about you at any time by sending a request to: privacy@bam.com.
 
You can also remove your personal (profile) information by submitting a request via the ‘personal information’ section on the bottom of the website. You can always unsubscribe from career related communications (such as the job alert) by using the unsubscribe button provided in the email.
